Certificate of Use (COU) & Change of Use Facilitation

These approvals often include a Certificate of Use (COU), Change of Use approval, or Converting Use permit. Proper documentation is required to demonstrate compliance with zoning regulations and applicable building codes.

What Is a Certificate of Use (C.O.U.)?

A Certificate of Use, commonly referred to as a C.O.U., is a city approval required before a business may operate at a specific location.

It is not the same as a Certificate of Occupancy and should not be confused with a Change of Use approval.

The purpose of the C.O.U. process is to allow the city to verify that:

  • The property is zoned properly for the intended business use
  • The occupancy classification is appropriate

  • The building complies with the Florida Building Code

  • The building complies with the Florida Fire Prevention Code

The city previously required businesses to obtain a business license. That requirement has since been replaced with the C.O.U. process.

If a business operates without an approved Certificate of Use, the city may issue a violation notice or cease-and-desist order.

What Is a Change of Use?

A Change of Use occurs when the proposed occupancy classification of a building differs from the previously certified occupancy classification.

For example, converting a retail space into a restaurant or converting office space into a medical clinic may trigger a Change of Use review.

When the proposed use does not match the previous occupancy classification, additional documentation is required to verify compliance with current code standards.

What Is a Converting Use Permit?

A Converting Use permit certifies that a change in occupancy has been reviewed and documented in accordance with Florida law.

Florida law requires a licensed design professional to prepare permit documents verifying that health, safety, and life safety requirements have been met prior to approval of a C.O.U. application.

In many cases, improvements to the building are required before approval can be granted.

What May Be Required for a Converting Use Permit?

When a building changes occupancy classification, upgrades are often necessary to comply with current code requirements.

Common upgrades may include:

  • Installation of exit lighting
  • Fire alarm system modifications

  • Ventilation system upgrades

  • Plumbing fixture additions

  • Accessibility improvements

  • Life safety modifications

Permit drawings must document existing conditions and proposed upgrades necessary to meet current standards.

Documentation Required

Certain properties require additional review by boards or commissions before approval may be granted.

  • Architectural Review Board (ARB)
  • Historical Preservation Commission (HPC)

  • Building Code Adjustment Board (BCAB)

  • Downtown Development Review Board (DDRB)

  • Zoning variances and exceptions

Projects located within designated districts or subject to specific zoning overlays may require board approval prior to permit issuance.

Zoning Verification

Before preparing permit documentation, zoning must be verified.

This includes confirmation of:
